Speeding is Against New Mexico State Law

A truck driver that is speeding is violating New Mexico state law.  Under New Mexico Stat. 66-7-301, “speed shall be so controlled by the driver as may be necessary: (1) to avoid colliding with a person, vehicle or other conveyance on or entering the highway; (2) to comply with legal requirements as may be established by the state highway and transportation department or the New Mexico state police division of department of public safety and the duty of all persons to use due care . . . .”

When a truck driver is speeding and collides with another vehicle or person on or near the roadway (pedestrian), this statute may be violated in both subsection (1) or (2).  Because of this, victims may be entitled to compensation for injuries under the doctrine of negligence per se.  This doctrine allows a victim who should have been protected from injury by a law, to bring a personal injury action and automatically prove liability by the sheer fact that the violator broken the law that caused the victim’s injuries.  Said differently, if the violation of a law to protect a person is violated and causes the injury, the victim can automatically prove liability.  This is a great tool for victims!
