Large commercial vehicles are dangerous no matter what speed they are going. Even low speed trucking accidents in parking lots can result in significant personal injuries or even catastrophic results. But when truck drivers are speeding and cause New Mexico trucking accidents, the injuries are magnified due to the heavy weight, larger size, and speed which generate oppressive momentum. This momentum can obliterate smaller passenger vehicles and seriously injure or wrongfully kill other truck drivers. In fact, speeding truckers are very likely to cause catastrophic personal injury to other truck drivers who share the same roads, especially in head-on collisions.
Our Albuquerque trucking accident lawyers know just how dangerous truckers who are speeding can be. We represent all victims if serious personal injury accidents, whether you are an innocent person walking on the sidewalk, in a passenger vehicles, or another truck driver who is injured in a debilitating collision, we can work with you and your loved ones to ensure that your rights to compensation are protected.
Speeding is Against New Mexico State Law
A truck driver that is speeding is violating New Mexico state law. Under New Mexico Stat. 66-7-301, “speed shall be so controlled by the driver as may be necessary: (1) to avoid colliding with a person, vehicle or other conveyance on or entering the highway; (2) to comply with legal requirements as may be established by the state highway and transportation department or the New Mexico state police division of department of public safety and the duty of all persons to use due care . . . .”
When a truck driver is speeding and collides with another vehicle or person on or near the roadway (pedestrian), this statute may be violated in both subsection (1) or (2). Because of this, victims may be entitled to compensation for injuries under the doctrine of negligence per se. This doctrine allows a victim who should have been protected from injury by a law, to bring a personal injury action and automatically prove liability by the sheer fact that the violator broken the law that caused the victim’s injuries. Said differently, if the violation of a law to protect a person is violated and causes the injury, the victim can automatically prove liability. This is a great tool for victims!
Damages from Speeding Truckers
Truck drivers are more likely to get seriously injured in crashes with other truck drivers. This is because most passenger vehicles will not commonly cause injuries to truck driver who sit higher up in a cabin and are usually more protected. But other trucks are likely to injury other truck drivers because of the sheer size of the trailer behind the truck—whether that be a box, tanker, or even just a flatbed.
Some common damages that passenger vehicle occupants and truck driver may sustain in a trucking accident due to a speeding truck accident include the following:
- Personal injuries, both past pain and suffering and future pain and suffering;
- Medical bills;
- Future medical expenses;
- Lost wages;
- Lost future earnings;
- Loss of consortium, which is time spent with loved one, relations with spouses, and general presence with loved ones like spouses, children, parents, and other family members (think being absent from the holiday dinner table because of your injuries);
- Physical therapy and occupational therapy;
- Equipment (like in amputations prosthetics), wheelchairs, and modifications to a house like ramps or elevators;
- Property damage; and
- Many other damages related to the crash.
